Amidst the push to make Obama’s Sequester ‘ as painful as promised’, we learn that the Regime has hired tens of thousands of Obama Activists to fill positions as ‘Navigators’ to steer Americans into Obamacare.

While lines at airports and cruise terminals grow into nightmare waits due to ‘sequester budget cuts’ of TSA staff doing security checks; control tower closings – the American taxpayer paid for 2 lavish Spring Break vacations for Obama’s two kids to go to the Bahamas with a bunch of their friends and an attachment army of Secret Service – and now we find that we taxpayers are going to pay a $48 an hour wage to Union members and community activists to ‘assist’ Americans through the maze of ObamaCare along with free translators to be provided on our dime as well.

You see, under the MarxoFascist rule of the Obama’s – we little people get punished, while they live large and kingly off the money they have taken by force from our paychecks.  Now they seek to rob us of more money and pay lavish salaries for Obama’s Union, street agitator cronies.

Obamacare to pay ‘navigators’ $20 to $48 an hour, provide free translators

Tens of thousands of health care professionals, union workers and community activists hired as “navigators” to help Americans choose Obamacare options starting Oct. 1 will be paid up to $48 an hour, more than six times the federal minimum wage of $7.25, according to new regulations issued Wednesday.

The 63-page rule covering navigators, drawn up by the Centers for Medicare & Medicaid Services, also said the government will provide free translators for those not fluent in English — no matter what their native language is.

“The proposed requirements would also include that such entities and individuals provide consumers with information and assistance in the consumer’s preferred language, at no cost to the consumer, which would include oral interpretation of non-English languages and the translation of written documents in non-English languages when necessary to ensure meaningful access,” said the regulations.

The rules also addressed conflict of interest and other potential issues that navigators could face as the public’s first stop on the Obamacare trail.

It is still not clear how many navigators will be required. California, however, provides a hint. It wants 21,000.

That could be an expensive proposition, since every one of them must be paid a minimum of $20 an hour. According to the new regulations, navigators and assistants will earn $20 an hour, while navigator project leaders will earn $29 an hour. Navigator senior executives will be paid $48 an hour.

The rules allow navigators to come from the ranks of unions, health providers and community action groups such as ACORN and Planned Parenthood. They are required to provide unbiased advice.

Some in Congress are already wary of the navigators. Louisiana Republican Rep. Charles Boustany Jr., chairman of the House Ways and Means Oversight subcommittee, has raised questions about a voter registration provision in the Obamacare application Americans will have to fill out to receive health care, and whether Democratic-leaning activists will influence which party people choose to join.

It’s actually refreshing to see the former mainstream media actually attempting to pull off some honest reporting.

Obama made more than 8 SPECIFIC promises that the Health Care negotiations would be done in full public view and on C-span.  Like everything else, he lied.  Here’s the video proof – though one has to wonder how long it will remain before Youtube yanks it.  Kudos to Naked Emperor News for nailing it.

Here’s the Wicked Witch of D.C. pulling a Josef Stalin on declaring that the health care debate has been the most “open and honest and transparent process”.  Notice the hatred and contempt she displays when pressed with the fact she is not being forthright with the fact the conference negotiations are taking place in secret behind closed doors, AFTER the fact the bills themselves were created in secret by unknown persons in the Obama Administration (Communist Van Jones reportedly helped write the omnibus Stimulus bill).

When pressed by the White House Press Corps, Obama Propaganda Stooge Robert Gibbs refused to answer any questions and spouted this belligerent gibberish.

So clearly, the Constitution, tradition, rules and ethics are out the window with Obama’s Politburo hacks recreating the Kremlin West and doing The Kruschev in ramming this thing down our throats whether we like it or not, and they refuse to be held to account whether we like it or not.

Then too perhaps, considering the numbers of Muslims overrunning Denmark, they too think Obama is a promised messiah, the Mahdi who will lead Islam to victory over the world.

Christians would recall that such a man is referred to in scripture as an anti-christ.

He is provocative in insisting on an outstretched hand, where others only see animosity.

His tangible results in the short time that he has been active – are few and far between. His greatest results have been created with words and speeches – words that remain in the consciousness of their audience and have long-term effects.

He comes from humble beginnings and defends the weak and vulnerable, because he can identify himself with their conditions.

And no we are not thinking of Jesus Christ, whose birthday has just been celebrated – - but rather the President of the United States Barack Hussein Obama.

For some time now, comparisons between the two have been a tool of cynical opinion that quickly became fatigued of the rapture that Obama instilled prior to and after the presidential election last year.

From the start, Obama’s critics have claimed that his supporters have idolised him as a saviour, thus attempting to dismantle the concrete hope that Obama has represented for most Americans.

The idea was naturally that the comparison between Jesus and Obama – which is something that the critics developed themselves – would be comical, blasphemous, or both.

If such a comparison were to be made, it would, of course, inevitably be to Obama’s advantage.

Today, his historic Health Reform is being passed through the American Senate – a welfare policy breakthrough that several of his predecessors have been unable to manage.

Despite all the compromises, it has finally been possible to ensure something so fundamental, as the right of every American not to be financially shipwrecked when their health fails them. Add to that the biggest ever financial support package in America’s history, a major disarmament agreement and the quickest-ever re-establishment of American reputation.

On the other hand, we have Jesus’ miracles that everyone still remembers, but which only benefitted a few. At the same time, we have the wonderful parables about his life and deeds that we know from the New Testament, but which have been interpreted so differently over the past 2000 years that it is impossible to give an unequivocal result of his work.

Obama is, of course, greater than Jesus – if we have to play that absurd Christmas game. But it is probably more meaningful to insist that with today’s domestic triumph, that he has already assured himself a place in the history books – a space he has good chances of expanding considerably in coming years.

Without, however, ever attaining the heavens….

Obama and America’s Marxist Politburo, Burying What Remains of The Republic

From Healthcare, to Cap and Trade, Obama and the Marxists in the Politburo have circumvented the Constitution and Congressional rules negating over two centuries of law and procedure.

While the American people were busy shopping for Christmas; catching the latest tabloid sexual tryst involving Tiger Woods’ pursuit of a harem; or standing in line at the unemployment office praying for yet another extension of benefits, the Politburo in Washington has buried the remaining vestiges of the Constitutional republic they swore an oath to defend and uphold.

Every day – another outrage, another lie, another trouncing of liberty takes place by this evil Marxist regime in power.  A few weeks ago – Obama did a pre-emptive end-run around the Constitutional requirement of Senate ratification of whatever Climate Change treaty Obama signs in Copenhagen by empowering the EPA to regulate the air we exhale, essentially implementing the punative accords the Global Warming Socialists want put upon America.

Pretending they were still beholden to the rule of law and our founding documents, the Marxist Democrats – doing the express will of Dear Leader Obama, have joined The One in throwing dirt into the hole in which Obama has flung what remained of a Constitutional Republic.  We learned this week that while the Senate was supposedly debating in public what was ostensibly the “healthcare bill” – Democrats were behind closed doors in secret, crafting “another” healthcare bill that they sought to slip in past everyone’s notice.

On Tuesday, American Socialist Party member Bernie Sanders introduced a 767 page Communist single-payer “amendment” (has there EVER been an “amendment” to a bill that large before?) on the Senate floor.  No one had seen or heard of this “amendment” until Sanders submitted it because it was drafted by key Democrats in secret behind closed doors. Stunned by this move after Republicans were shut out of the entire process, Sen. Tom Coburn (R-Okla.) requested that any health care amendment considered by the Senate be offered at least 72 hours in advance of debate and with a full cost report.  He was rebuffed by Sen. Max Baucus (D-MT) for making the request and was denied.  Coburn then invoked the parliamentary right to require that Sanders’ entire Amendment be read aloud. 

This sent the Marxists into shrill orbit, who essentially demanded that they be allowed to shove their amendments drafted in secret to the floor without either the Senators or the Americans people the ability to know what the Amendments contain before the Senate votes on them.

Of course the GOP strategy was to slow down the Marxist juggernaut of a health care bill after bribes, graft, extortion and direct threats were made to Democrats who were wavering on their support of Obama’s final nail in the coffin of liberty.  Using parlimentary rules that were established back in 1789 that affords Senators the right to ask that bills be read unless a unanimous consent vote to suspend is given, Little Mussolini Harry Reid decided to haul the Parliamentary Officer back into his chambers to make him an ‘offer he could not refuse’.  Three hours after the reading of Sanders’ single-payer amendment began, Harry Reid threw out over two centuries of rules and traditions – to allow the Socialist Sanders to withdraw his Amendment.  This was a gross violation of not only procedure, but American tradition of law and precedent.

The Republic was swept into the grave – and now the Marxists are planning to throw dirt upon a gasping system that our Founders established once Obama gets his legislative ability to empower the government to decide all matters of everyone’s life…… and death.

As Minority Leader Mitch McConnell (R-K) said in a statement late Thursday: “Here’s the most outrageous part: at the end of this rush, they want us to vote on a bill that no one outside the Majority Leader’s conference room has even seen.  That’s right. The final bill we’ll vote on isn’t even the one we’ve had on the floor. It’s the deal Democrat leaders have been trying to work out in private”.  

What McConnell finally woke up to was the fact that the Democrats were orchestrating a bait and switch by Obama, Reid and Pelosi right under his nose.  The Sanders Amendment created a single-payer health care program by expanding Medicare to the point it would essentially take over as the instrument of administering Universal Government-run Fascist Health Care.

This is nothing new – in fact, it is exactly what Obama himself has stated was the process by which he envisioned implementing single-payer Socialized Health Care.  Sanders’ Amendment was simply the Obama-drafted switch to the ruse and bait Harry Reid was feeding the Senate for the last few weeks.

“This entire process…is essentially a charade,” McConnell said.

Obama’s Communists Now Ruling the USA: Republic is Formally Dead

The bribes issued by Sen. Harry Reid and the threats issued by the Marxist usurper and dictator-in-Chief in order to garner votes for the ObamaCare Death Plan have now reached almost legendary proportions. In order to end cloture, Reid actually had $300 Millions for Louisiana written into the Senate’s ObamaCare Death Plan version to buy Senator Mary Landrieu’s (D-LA) vote.

It worked. Landrieu even bragged about it. Now, the would-be Chicago-style godfather Obama has threatened the hold-out Nebraska Democrat Senator Ben Nelson with closure of Nebraska’s Offutt Air Force base (which employs over 10,000 people and is the headquarters for the US Strategic Command) if he doesn’t play ball with him, the USA’s head mobster, and vote for the bill that will begin the ultimate slavery of the American people.

Note: Obama is so bent upon getting his way and destroying the USA that he is now openly—and in full view of all—threatening to place the country in even more jeopardy. The Communist Obama Government now has a stranglehold on the United States of America, its legislators and its people and he will NOT willingly let go. In fact, as his smile beams even more broadly he is squeezing ever tighter to end our lives and the life of our country.

In order to bring former Democrat and now Independent Sen. Joe Lieberman (I-CT) into line, Obama ordered his minions to go on a search-and-destroy mission against Lieberman’s wife Hadassah. After his Tuesday press conference, it appears that Sen. Lieberman may have folded like the proverbial cheap suit.

Here are only a few of the facts:

1. The ObamaCare Death Plan will gut Medicare by at least $500 Billions—in order to rid Obama & Co of Senior citizens. Seniors were forced into Medicare years ago and now they’re being told it’s time for them to die
2. The pro-abortion language, if removed for the vote, will be added back in when the Senate and House cone together to “blend” the bills
3. The government-run portion of the bill, which was ostensibly removed, will be added back in when the Senate and House cone together to “blend” the bills. Even if it isn’t now done now, the framework for all of the additional Obama-run new government agencies (over 140 of them) will remain in the Obama Death Plan
4. The Marriage Penalty remains in the Obama Death Plan. You didn’t seriously believe this was about health care—did you?
5. The Death Plan includes provisions for the Obama-run government to enter private homes in order to observe how parents are raising their children and to “counsel” said parents

There is so much wrong with this plan and the House plan—think total slavery—that it cannot be fixed. So, they will pass it anyway with a “damn the people” and “damn the Republic” attitude. When this horror passes, folks, it will mark the formal end of our Republic. We will then officially enter the beginnings of the Bondage Phase of our existence. Our rulers in Washington D.C. stopped listening to us some time back. They pay no attention to us when we march and/or question them at Town Hall meetings. Instead, Obama has found a way to ensure that he and his like-minded cohorts are never again voted out of office. The Obama has announced his plan to also shove Amnesty for Illegals and Democrat votes down our throats. Obama & Co pass one set of laws for what used to be We-the-People and another set for themselves—the ruling elite.

This is it. It’s fast approaching the now or never moment. Once more for the troops who understand: “We must no longer reason or deliberate. We only want concord and steadiness. The lot is cast. I’ve given a lot of thought to where we have arrived, and the cognitive dissonance that exists among Americans that refuse to allow themselves to accept a serious reality; that we are at war. 

We are at war for our very survival as a culture. A war that will determine if we live as destitute and dependent slaves of a Marxist oligarchy, or fight to retain what is left of our liberties for a little season longer.

It’s not a shooting war – yet. But the machinations set into motion most assuredly guarantee misery and death at the hands of the state and by the consequences of what the state is doing.

What I find disconcerting is the refusal of Americans to accept this reality. We constantly hear by those who think themselves leaders about the need to ‘compromise’; the need to be ‘civil’; the need to be ‘Christian’; the need to be moderate’. What that says to me is that the leaders of the nation are telling us to bend over, take it and enjoy it – because that is what ‘civil’ people do. That is what ‘Christians’ should do.

Of course if you don’t submit to such admonitions, you are called a hypocrite, and extremist and so forth – applying Rule No. 4 under Tactics of Saul Alinsky’s Rules For Radicals: 4. “Make the enemy live up to its own book of rules”. Of course that is done so that they can destroy you and your opposition to what they plan to do to you. It’s called using your own morality against you. They make you fight according to the rules they say you should adhere to – while they move outside those rules to wage the war while forbiding you to defend yourself by misapplication of your rules.

What they essentially want is for us to be carpets and allow tyranny to walk all over you – because as some would say: that is what Jesus would do.

Well that’s nonsense. Biblically speaking all one has to do is read the bible’s accounts of what happens when Jesus returns in Zechariah 14 and in Revelation to understand he’s not coming back as a lamb – but as a warrior seated on a white horse with a sword – to wage war on those who come against Him at His coming. Once again illustrating the true adage that peace comes through the other side of war.

But still we’re told by among our own numbers that we need to stop being confrontational, to be generous to our enemies while they prepare to rape us.

Meanwhile the Marxist juggernaut plows onward, ripping up our solid foundations and imposing with little to no opposition – tyranny of a sort never seen on these shores.

Americans are willfully oblivious to what is happening to them. They refuse to recognize the war that the Left have waged upon their liberties for decades. 

It’s not too dissimilar from the indifference we and our leaders held towards radical Islam in the 80′s and 90′s, even though the leaders of Jihadist Islam declared war on America and the West in both word, thought and deed. We slept in the face of a clear and present danger – and ultimately thousands lost their lives by their hands and we awoke one bright September morning to horror that bewildered the majority of the nation that never saw it coming.

Likewise the Marxists in this nation have declared war on We The People, Our Constitution, our Rights and Liberty itself. They have done so in word, thought and deed, and we would understand what they are doing if only we paid attention to what they were actually doing via stealth and double-speak. They have achieved via deceit, the highest positions of power in the land, and thus having control of our education system, the media and government – have gone from subtle sabateurs – to in-your-face warfare.

They are bold in their declared war of “hope and Change” against the foundations of America. They have gone to war against God and Christian Principles and values in our society. They have lofted up government above God and made the people dependent upon them for their sustenance. They protect sin and abomination by law – and are about the task of criminalizing our faith and our very thoughts.

All under our very noses, while we watch them do it.

And yet we are told to be civil. To compromise. To engage in dialogue, so that we might somehow persuade those that support tyrants to our way of thinking.

Such is madness!

It’s a tool of the enemy to divide and conquer us from within. Men with no loyalty except to their power and ideology preying upon those who always want to see the better angels of mankind; who pervert the scriptures and preach to the biblically ignorant that Jesus was a Socialist – and to be a good Christian means we must adopt the Marxist plank – to eschew war but to wage it on those who refuse to convert to the new religion of ‘compassion’.

We have lost the language, and allow the enemy to define it for us – whereby we play by their ever-changing rules. Then we have those among us who tell us it’s all rotten and wrong unless we follow them and their “truths”. They assail those who stand up to tyranny because they do not follow specific ‘chosen’ leaders, so the opposition to a clear enemy becomes muddied and lost as we battle among ourselves and afford the Marxists the achievement of their goals without hardly any opposition.

Anarchy is being bred, along with the portents of a bloodbath that will make the French blush in astonishment.

One day, a majority are going to wake up to an absolute horror that their lives are in, and they will suddenly ask themselves “how could this happen?”. I fear by the time that happens, it will be too late to stop the things that will be visited upon us – things our minds cannot wrap themselves around. 

For now a majority refuse to recognize reality, because they assume their lives will somehow return to what they were – as if that was the way the world resides normally. They have no clue that our very short 70 year stint of prosperity and world leader is an anomaly in world history. Those that are aware – are perhaps planning to go grey, sit on the fence and let the tyrants march on through so they can remain unnoticed and untouched – but eventually they too, will be left to beg for whatever bread crumbs they can obtain from the Oligarch’s table.

If we are to avoid that fate – we must be at war.

Before that war turns hot, or before we are being loaded into camps or prisons – the war has to be fought here and now on the battlefield of ideas and discourse. If we do not fight it now, then into bloodshed, camps and prisons we will go. That is the fate the Marxists have envisioned for those of us beholden to liberty, who openly defy them.

We cannot pussyfoot around with playing nice with Marxists and their supporters. We cannot pretend this is a civil society where we can all agree to disagree about the trunk of the tree. The trunk of the tree of liberty is what sustains and keeps us, and we cannot entertain those that say we need to cut it down and replant it – or waste time arguing with those who pretend to be of us – while preaching that the fruit you freely choose to eat from the tree is rotten and to eat the fruit of their tree instead.

They need to be opposed and fought. We need to reject the calls for compromise with those who work to undermine our liberties and refuse to engage fools in debate when their clear motive is to ridicule and sow discord among us. Ideas and agendas anathema to liberty need to be cut down, stomped on and rendered irrelevant.

We do not need to answer fools according to their folly, we simply need to kill their foolishness and not permit it to remain or give it any legitimacy. Marxist thoughts, ideas and plans need to be shown what they are and burned in a fury of outrage and contempt. No quarter must be given to the enemy and his ideas, for assuredly – they will give yours no quarter. They are actively engaged in demonizing you. They will demonize and criminalize you regardless of how reasonable you sound, no matter whether you remain silent or not. They wage war on us – whether we want it or not.

They want us to lie down and compromise and capitulate. They want us to surrender by sitting down and shutting up while they move to tighten the noose around your neck. 

If you struggle and oppose these efforts – they may charge you with hate crimes, hating the poor, being racists and Nazis. The truth is they are projecting what they themselves are. So call them on it. They hate us anyway – so why pretend otherwise? They are at war with us – let’s start acting like it!

We can choose not to fight and be at war – but that makes little difference to the Marxists and the Politburo in power, because THEY are assuredly at war with you and liberty in this nation.

It’s time to fight this war.

Obama Messiah “Forgives” Us Hoi-Polloi – While His Cronies Go Nuclear on Healthcare

“It’s a pretty mess you got me into, but I forgive you, That’s how I feel about you. You’re all forgiven.” 

The messiah-complex has gone straight to this narcissist’s head – as he absolves those of us who oppose his Marxist coup and revolution.  Dear Leader Obama Thursday night slammed his critics in Congress for blasting Democratic attempts to overhaul health care before he launched into a christ-like absolution of the same.

“What I reject is when some folks sit on the sidelines and root for failure,” he said at a fundraiser in San Francisco.  ”I’m busy, “Nancy (Pelosi)’s busy with her mop cleaning up somebody else’s mess. We don’t want somebody sitting back saying you’re not holding the mop the right way”. 

“Why don’t you grab a mop? Why don’t you help clean up? 
“You’re not mopping fast enough,” the president said, imitating his critics’ comments. 
“That’s a socialist mop. 
“Grab a mop!” he demanded. “Let’s get to work.” 

The hubris narcissist then quoted Abraham Lincoln to describe the situation he inherited in January while blaming the previous Administration – and those who currently oppose his plans.

“I want everybody to know who’s standing in the way of progress, I’m not tired. I’m just getting started. You can throw whatever you want at me. Keep it coming. 

“We’re going to get this done. We’re going to get health care done. We’re going to get clean energy done. We’re going to get climate change done. We’re going to fix our schools. We’re going to fix the problems internationally that I was elected to deal with.” 

“We are going to pass health care reform by the end of this year….. Change is hard. And big change is harder. I don’t quit. We get this stuff done. We keep on going until we get it done.“ 

That was followed by the crowd eerily chanting Seig Heil! – er…. “Yes we can!” (same difference).  As many have noted – the Marxists are going to shove their agenda down our throats – whether we like it, or not. Whether 90% of the American population is against it – or not.

Because we have lost the republic to a Marxist coup – and they now run the country.

And how will they ram Obama’s final nail in the coffin of liberty when there are enough doubters even on the Democrat side to sideline his Fascist takeover of Health Care?

The nuclear option, which excused criminal tax evader Charlie Rangel has set in motion yesterday by passing the motion out of the House Ways and Means Committee.

The Marxists will do everything and anything to impose their will upon us and the country – until they reach the point that Obama can act by simple decree.

Rangel told Camp that he would not have preferred to do it this way, but leadership — i.e., Speaker Pelosi — forced his hand.  “We had let them know we were offering amendments and we had heard no problem with that until we got there today,” Camp said. “Chairman Rangel said leadership made him do it, but he did it, not the leadership.” This was the final opportunity for debate and amendments to the bill on a committee level. The Budget Committee will simply vote to pass the bill out with an up or down vote that would certify that the bill has met the reconciliation requirements. “It’s supposed to only be bills that impact the deficit,” Camp added. “And what they’ve done is said this bill will save a billion dollars. That’s what we were ordered under the budget resolution to do. They’ll fulfill that marker, but they’ll use that obviously to spend a lot more.” The bill being certified for “reconciliation” is the Ways & Means version of H.R. 3200 that was passed out of committee before the August break, and before it was read aloud at town hall meetings across the country and blasted by voters across the country. It contains all of the horrors previously exposed: federal funding of abortion, coverage for illegal aliens, comparative effectiveness, healthcare rationing, deep cuts to Medicare. Everything the American people overwhelmingly reject. “Since the time we voted on this bill until today, we’ve had new issues develop, we’ve had new scores from the Congressional Budget Office which is the non-partisan expert agency that reviews our legislation,” Camp said. “We felt it was important to talk about the issues. We’ve had some new developments, new information.”  “Let’s have 72 hours to read the bill and have the bill available,” Camp continued. “That didn’t get any certain discussion today. Let’s make sure members of Congress are part of any health care bill that passes. That didn’t get any debate today. Let’s make sure that we do not have non-citizens here illegally getting government funded healthcare. Let’s make sure we don’t use tax dollars to fund and pay for abortion. We didn’t get to vote on that today.”  Reconciliation is a parliamentary process that was created for use solely on the reduction of spending bills in order to reduce the deficit. Spending bills must originate in the House, and when passing the budget, the full House can include language in the budget bill to a specific committee instructing them to reduce spending by a specific amount in order to reduce the deficit.  Having learned from the 1993 Hillarycare debacle when the American people utterly rejected the notion of the government takeover of health care, House Democrats placed reconciliation language into the 2010 budget to facilitate passage of the government takeover of health care with Obamacare through budget reconciliation. In the case of H.R. 3200, the reconciliation instruction was to reduce the cost of the health care bill by $1 billion — a bill that by some estimates will cost taxpayers a minimum of $1.6 trillion. “This is after August when the American people clearly weighed in and said, ‘Hey, hold up. We want to be part of this. We want to have some more openness,’” Camp said. “I think they feel the less people know the better; that they, the majority, are better off because they don’t have to explain. People don’t know what it is they’re really doing. We won’t find out until it’s actually done.” Since it has now cleared the Ways and Means Committee (fulfilling the $1 billion reconciliation requirement), H.R. 3200 will go to the Budget Committee where they will do the same thing that was done today in Ways & Means. They will agree on a straight party line vote that the bill has met the reconciliation requirements. The bill then goes to Pelosi and the Rules Committee where Pelosi will do the same thing Sen. Harry Reid is doing with the two Senate bills right now: Pelosi will merge the three House versions of H.R. 3200 together into whatever she wants it to be, then she will schedule it for a floor vote. H.R. 3200 could see a floor vote in the next two weeks, likely no later than the first week of November if Democrats believe they have the votes for passage. If the bill does pass a full House vote, and that’s a big “if” given the deep divides over the issues among Democrats, the bill would then be sent over to the Senate.

This was the idea that all people of social security age, should be brought under a program of compulsory health insurance. This would not only be our senior citizens, this would be the dependents and those that are disabled, this would be young people if they are dependents of someone eligible for social security.”   - Ronald Reagan, 1961

What The Obama House HealthCare Bill Actually Says

This is just an analysis of the HOUSE bill. No one has seen the Senate Bill yet. But we can assume that the same death panels that constructed this one, also were involved in constructing the Senate version.

The Health Care Bill: What HR 3200, ‘‘America’s Affordable Health Choices Act of 2009,” Says

What does the bill, HR 3200, short-titled ‘‘America’s Affordable Health Choices Act of 2009,” actually say about major health care issues? I here pose a few questions in no particular order, citing relevant passages and offering a brief evaluation after each set of passages.

This bill is 1017 pages long. It is knee-deep in legalese and references to other federal regulations and laws. I have only touched pieces of the bill here. For instance, I have not considered the establishment of (1) “Health Choices Commissio0ner” (Section 141); (2) a “Health Insurance Exchange,” (Section 201), basically a government run insurance scheme to coordinate all insurance activity; (3) a Public Health Insurance Option (Section 221); and similar provisions. 

This is the evaluation of someone who is neither a physician nor a legal professional. I am citizen, concerned about this bill’s effects on my freedom as an American. I would rather have used my time in other ways—but this is too important to ignore.

We may answer one question up front: How will the government will pay for all this? Higher taxes, more borrowing, printing money, cutting payments, or rationing services—there are no other options. We will all pay for this, enrolled in the government “option” or not.

(All bold type within the text of the bill is added for emphasis.)

1. 1. WILL THE PLAN RATION MEDICAL CARE?

This is what the bill says, pages 284-288, SEC. 1151. REDUCING POTENTIALLY PREVENTABLE HOSPITAL READMISSIONS:

‘(ii) EXCLUSION OF CERTAIN READMISSIONS.—For purposes of clause (i), with respect to a hospital, excess readmissions shall not include readmissions for an applicable condition for which there are fewer than a minimum number (as determined by the Secretary) of discharges for such applicable condition for the applicable period and such hospital.

and, under “Definitions”:

‘‘(A) APPLICABLE CONDITION.—The term ‘applicable condition’ means, subject to subparagraph (B), a condition or procedure selected by the Secretary . . .

and:

‘‘(E) READMISSION.—The term ‘readmission’ means, in the case of an individual who is discharged from an applicable hospital, the admission of the individual to the same or another applicable hospitalwithin a time period specified by the Secretary from the date of such discharge.

and:

‘‘(6) LIMITATIONS ON REVIEW.—There shall be no administrative or judicial review under section 1869, section 1878, or otherwise of— . . .
‘‘(C) the measures of readmissions . . .

EVALUATION OF THE PASSAGES:

1. This section amends the Social Security Act
2. The government has the power to determine what constitutes an “applicable [medical] condition.”
3. The government has the power to determine who is allowed readmission into a hospital.
4. This determination will be made by statistics: when enough people have been discharged for the same condition, an individual may be readmitted.
5. This is government rationing, pure, simple, and straight up.
6. There can be no judicial review of decisions made here. The Secretary is above the courts.
7. The plan also allows the government to prohibit hospitals from expanding without federal permission: page 317-318.

2. WILL THE PLAN PUNISH AMERICANS WHO TRY TO OPT OUT?

What the bill says, pages 167-168, section 401, TAX ON INDIVIDUALS WITHOUT ACCEPTABLE HEALTH CARE COVERAGE:

‘‘(a) TAX IMPOSED.—In the case of any individual who does not meet the requirements of subsection (d) at any time during the taxable year, there is hereby imposed a tax equal to 2.5 percent of the excess of—
(1) the taxpayer’s modified adjusted gross income for the taxable year, over
(2) the amount of gross income specified in section 6012(a)(1) with respect to the taxpayer. . . .”

EVALUATION OF THE PASSAGE:

1. This section amends the Internal Revenue Code.
2. Anyone caught without acceptable coverage and not in the government plan will pay a special tax.
3. The IRS will be a major enforcement mechanism for the plan.

3. WHAT CONSTITUTES “ACCEPTABLE” COVERAGE?

Here is what the bill says, pages 26-30, SEC. 122, ESSENTIAL BENEFITS PACKAGE DEFINED:

(a) IN GENERAL.—In this division, the term ‘‘essential benefits package’’ means health benefits coverage, consistent with standards adopted under section 124 to ensure the provision of quality health care and financial security . . .

(b) MINIMUM SERVICES TO BE COVERED.—The items and services described in this subsection are the following:
(1) Hospitalization.
(2) Outpatient hospital and outpatient clinic services . . .
(3) Professional services of physicians and other health professionals.
(4) Such services, equipment, and supplies incident to the services of a physician’s or a health professional’s delivery of care . . .
(5) Prescription drugs.
(6) Rehabilitative and habilitative services.
(7) Mental health and substance use disorder services.
( Preventive services . . .
(9) Maternity care.
(10) Well baby and well child care . . .

(c) REQUIREMENTS RELATING TO COST-SHARING AND MINIMUM ACTUARIAL VALUE . . .

(3) MINIMUM ACTUARIAL VALUE.—
(A) IN GENERAL.—The cost-sharing under the essential benefits package shall be designed to provide a level of coverage that is designed to provide benefits that are actuarially equivalent to approximately 70 percent of the full actuarial value of the benefits provided under the reference benefits package described in subparagraph (B).

EVALUATION OF THE PASSAGES:

1. The bill defines “acceptable coverage” and leaves no room for choice in this regard.
2. By setting a minimum 70% actuarial value of benefits, the bill makes health plans in which individuals pay for routine services, but carry insurance only for catastrophic events, (such as Health Savings Accounts) illegal.

4. WILL THE PLAN DESTROY PRIVATE HEALTH INSURANCE?

Here is what it requires, for businesses with payrolls greater than $400,000 per year. (The bill uses “contribution” to refer to mandatory payments to the government plan.) Pages 149-150, SEC. 313, EMPLOYER CONTRIBUTIONS IN LIEU OF COVERAGE

(a) IN GENERAL.—A contribution is made in accordance with this section with respect to an employee if such contribution is equal to an amount equal to 8 percent of the average wages paid by the employer during the period of enrollment (determined by taking into account all employees of the employer and in such manner as the Commissioner provides, including rules providing for the appropriate aggregation of related employers). Any such contribution—

(1) shall be paid to the Health Choices Commissioner for deposit into the Health Insurance Exchange Trust Fund, and
(2) shall not be applied against the premium of the employee under the Exchange-participating health benefits plan in which the employee is enrolled.

(The bill then includes a sliding scale of payments for business with less than $400,000 in annual payroll.)

The Bill also reserves, for the government, the power to determine an acceptable benefits plan: page 24, SEC. 115. ENSURING ADEQUACY OF PROVIDER NETWORKS.

5 (a) IN GENERAL.—A qualified health benefits plan that uses a provider network for items and services shall meet such standards respecting provider networks as the Commissioner may establish to assure the adequacy of such networks in ensuring enrollee access to such items and services and transparency in the cost-sharing differentials between in-network coverage and out-of-network coverage.

EVALUATION OF THE PASSAGES:

1. The bill does not prohibit a person from buying private insurance.
2. Small businesses—with say 8-10 employees—will either have to provide insurance to federal standards, or pay an 8% payroll tax. Business costs for health care are higher than this, especially considering administrative costs. Any competitive business that tries to stay with a private plan will face a payroll disadvantage against competitors who go with the government “option.”
3. The pressure for business owners to terminate the private plans will be enormous.
4. With employers ending plans, millions of Americans will lose their private coverage, and fewer companies will offer it.
5. The Commissioner (meaning, always, the bureaucrats) will determine whether a particular network of physicians, hospitals and insurance is acceptable.
6. With private insurance starved, many people enrolled in the government “option” will have no place else to go.

5. DOES THE PLAN TAX SUCCESSFUL AMERICANS MORE THAN OTHERS?

Here is what the bill says, pages 197-198, SEC. 441. SURCHARGE ON HIGH INCOME INDIVIDUALS

‘‘SEC. 59C. SURCHARGE ON HIGH INCOME INDIVIDUALS.
‘‘(a) GENERAL RULE.—In the case of a taxpayer other than a corporation, there is hereby imposed (in addition to any other tax imposed by this subtitle) a tax equal to—
‘‘(1) 1 percent of so much of the modified adjusted gross income of the taxpayer as exceeds $350,000 but does not exceed $500,000,
‘‘(2) 1.5 percent of so much of the modified adjusted gross income of the taxpayer as exceeds $500,000 but does not exceed $1,000,000, and
‘‘(3) 5.4 percent of so much of the modified adjusted gross income of the taxpayer as exceeds $1,000,000.

EVALUATION OF THE PASSAGE:

1. This bill amends the Internal Revenue Code.
2. Tax surcharges are levied on those with the highest incomes.
3. The plan manipulates the tax code to redistribute their wealth.
4. Successful business owners will bear the highest cost of this plan.

6. DOES THE PLAN ALLOW THE GOVERNMENT TO SET FEES FOR SERVICES?

What it says, page 124, Sec. 223, PAYMENT RATES FOR ITEMS AND SERVICES:

(d) CONSTRUCTION.—Nothing in this subtitle shall be construed as limiting the Secretary’s authority to correct for payments that are excessive or deficient, taking into account the provisions of section 221(a) and the amounts paid for similar health care providers and services under other Exchange-participating health benefits plans.

(e) CONSTRUCTION.—Nothing in this subtitle shall be construed as affecting the authority of the Secretary to establish payment rates, including payments to provide for the more efficient delivery of services, such as the initiatives provided for under section 224.

EVALUATION OF THE PASSAGES:

The government’s authority to set payments is basically unlimited.
The official will decide what constitutes “excessive,” “deficient,” and “efficient” payments and services.

7. WILL THE PLAN INCREASE THE POWER OF GOVERNMENT OFFICIALS TO SCRUTINIZE OUR PRIVATE AFFAIRS?

What it says, pages 195-196, SEC. 431. DISCLOSURES TO CARRY OUT HEALTH INSURANCE EXCHANGE SUBSIDIES.

‘‘(A) IN GENERAL.—The Secretary, upon written request from the Health Choices Commissioner or the head of a State-based health insurance exchange approved for operation under section 208 of the America’s Affordable Health Choices Act of 2009, shall disclose to officers and employees of the Health Choices Administration or such State-based health insurance exchange, as the case may be, return information of any taxpayer whose income is relevant in determining any affordability credit described in subtitle C of title II of the America’s Affordable Health Choices Act of 2009. Such return information shall be limited to—
‘‘(i) taxpayer identity information with respect to such taxpayer,
‘‘(ii) the filing status of such taxpayer,
‘‘(iii) the modified adjusted gross income of such taxpayer (as defined in section 59B(e)(5)),
‘‘(iv) the number of dependents of the taxpayer,
‘‘(v) such other information as is prescribed by the Secretary by regulation as might indicate whether the taxpayer is eligible for such affordability credits (and the amount thereof), and
‘‘(vi) the taxable year with respect to which the preceding information relates or, if applicable, the fact that such information is not available.

And, page 145, section 312, EMPLOYER RESPONSIBILITY TO CONTRIBUTE TOWARDS EMPLOYEE AND DEPENDENT COVERAGE:

(3) PROVISION OF INFORMATION.—The employer provides the Health Choices Commissioner, the Secretary of Labor, the Secretary of Health and Human Services, and the Secretary of the Treasury, as applicable, with such information as the Commissioner may require to ascertain compliance with the requirements of this section.

EVALUATION OF THE PASSAGE:

1. This section amends the Internal Revenue Code
2. The bill opens up income tax return information to federal officials.
3. Any stated “limits” to such information are circumvented by item (v), which allows federal officials to decide what information is needed.
4. Employers are required to report whatever information the government says it needs to enforce the plan.

8. DOES THE PLAN AUTOMATICALLY ENROLL AMERICANS IN THE GOVERNMENT PLAN?

What it says, page 102, Section 205, OUTREACH AND ENROLLMENT OF EXCHANGE-ELIGIBLE INDIVIDUALS AND EMPLOYERS IN EXCHANGE-PARTICIPATING HEALTH BENEFITS PLAN:

(3) AUTOMATIC ENROLLMENT OF MEDICAID ELIGIBLE INDIVIDUALS INTO MEDICAID.—The Commissioner shall provide for a process under which an individual who is described in section 202(d)(3) and has not elected to enroll in an Exchange-participating health benefits plan is automatically enrolled under Medicaid.

And, page 145, section 312:

(4) AUTOENROLLMENT OF EMPLOYEES.—The employer provides for autoenrollment of the employee in accordance with subsection (c).

EVALUATION OF THE PASSAGES:

1. Do nothing and you are in.
2. Employers are responsible for automatically enrolling people who still work.

9. DOES THE PLAN EXEMPT FEDERAL OFFICIALS FROM COURT REVIEW?

What it says, page 124, Section 223, PAYMENT RATES FOR ITEMS AND SERVICES:

(f) LIMITATIONS ON REVIEW.—There shall be no administrative or judicial review of a payment rate or methodology established under this section or under section 224.

And, page 256, SEC. 1123. PAYMENTS FOR EFFICIENT AREAS.

‘‘(C) LIMITATION ON REVIEW.—There shall be no administrative or judicial review under section 1869, 1878, or otherwise, respecting—
‘‘(i) the identification of a county or other area under subparagraph (A); or
‘‘(ii) the assignment of a postal ZIP Code to a county or other area under subparagraph (B).

EVALUATION OF THE PASSAGES:

1. Sec. 1123 amends the Social Security Act, to allow the Secretary to identify areas of the country that underutilize the government’s plan “based on per capita spending.”
2. Parts of the plan are set above the review of the courts.
